Explain Amendments 5 - 10



Summary

On september 25th, 1789 congress proposed the Bill of rights and on December 15th two years later the bill of rights was ratified. the bill of rights consisted of the the first ten amendments which gave rights to the people or citizens of the United States of America. the fifth amendment through the seventh amendment dealt manly with the rights given to alleged criminals, specifically the rights of an accusted person, to a speedy trial, to a trial by jury in cival cases, and limits of fines and punishments. the ninth and tenth amendments give rights to the people and state.


5TH AMENDMENT- Rights of accused persons (1791)- No person should have to answer questions for a capital or anyother crime unless they are presented to a grand jury, unless the crime arises in the naval forces or the military. Also no person will be tried for the same crime twice can be put in jeopardy of thier life. They also will not be deprived of life, liberty, or property. Plus no private property can be taken for public use without just cause.

6TH AMENDMENT- Right to a speedy, public trial (1791)- The police must follow rules when they question a suspect. if you are suspected of a crime you must be read your Miranda rights. The trial must happen in the state that the crime was committed. The ditrict must be informed of the nature and cause of the accusation. It also guarantees you with certian rights if you are ever tried for a crime. You also have the right to know what you are being charged for and why you are being held in jail. Also you have the right to know who accused you of the crime. You also have the right to force anyone you think can help you with the case to come to the trial.

7TH AMENDMENT- Trial by jury in civil cases (1791)- If the value in controversy shall exceed $20 the right of trial by jury shall be preserved, and not reexamined in any court of the United States.

8TH AMENDMENT- Limits of fines and punishment (1791)- The amount of bail shall not be increased, nor fines can be added, and cruel and unusual punishment can not be put into action. You are granted bail and that in a way shows the jury or judge that you will be coming back for your trial. If you do not show up for your trial then your bail will be taken away. Bail also allows the accused to work on thier defense with other wise would be very hard to work on from jail. Many people are not able to pay the bail so they are granted a bail bondsman, that provides the money for the bail. If the person tries to skip town and do not show up for thier trial a bounty hunter will be sent after them to put them in jail.

9TH AMENDMENT- Rights of people (1791)- Certian rights can not be taken away from a person at any time. This amendment is in place to cover the rights of people that were not stated in the constitution or other amendments.

10 AMENDMENT- Powers of states and people (1791)- The power not given to the United States by the constitiution are reserved for the States or to the people respectively. The national goverment can not control any area that is not in the constitution. So if it is not in the constitution that means that it is controlled by the states. The states regulate many of our rights not the national government.
